'Principle of Proportionality vs. Prohibition of Arbitrariness: the Dispute over the General Principle of Equality'



The work addresses a classical, yet unsolved problem in the German legal doctrine of fundamental rights: the question of whether the principle of proportionality or the prohibition of arbitrariness applies to the general principle of equality. The focus lies on the investigation of the structure of the principle of proportionality, the analysis of its prerequisites and the examination of whether the general principal of equality satisfies them. Finally remains the prohibition of arbitrariness.
